Terms and Conditions for Purchase of Training and Educational Materials from DomeAcademy (https://domeacademy.domeshells.com.au)

 

This Agreement is made on the date of purchase of any Training Services and Materials available from this website, including but not limited to Information, E-Manuals, Guides, Plans, Specifications, Video Courses, and Webinars.

 

BETWEEN: Domeshells Australia Pty Ltd (ABN 96 096426274), hereinafter referred to as “The Company,” and The Purchaser, hereinafter referred to as the “Student Member.”

 

By purchasing any material from this website, the Student Member agrees to the following terms and conditions:

 

  1. Intellectual Property and Usage

The Company is the owner and developer of the systems for building dome-shaped structures as demonstrated in the e-manuals, guides, and online video courses. The Student Member agrees not to copy, reproduce, or distribute any of the training materials, manuals, or courses, except for their own personal requirements. All rights are reserved by Domeshells Australia Pty Ltd.

 

  1. Structural Compliance and Approval

  • Basalt Fiber Reinforced 3.0m Dome: While the structural design of the 3.0m dome featured in the training materials is intended to meet Category 5 cyclonic wind speeds, these materials cannot be used for council construction approval purposes. A specifically relevant and certified structural design for a specific property must be obtained for council approval.
  • Bamboo Dome Building System: The Student Member acknowledges that the Bamboo Dome Building system does not comply with the Australian Building Code.
  • Responsibility: It is the sole responsibility of the Student Member to satisfy themselves of their capability to perform the work and to ensure compliance with local authorities and engineering requirements.

 

  1. Indemnity and Liability

The Student Member indemnifies The Company against any actions, suits, claims, demands, proceedings, losses, damages, compensation, sums of money, costs (including solicitor and client costs), charges, and expenses arising out of the promotion, sale, supply, or other use of the Training Materials by The Company, its servants, or agents. The defense of any litigation to which this clause applies is to be under the control of The Company, its solicitors, and counsel, and all legal costs and expenses of any such litigation are to be borne by the Student Member.

 

  1. Disclaimer

The methods and systems demonstrated and taught in any of the Training Services and Materials by Domeshells Australia are for educational purposes only. The Company makes no guarantee that any structure built by any person buying the manuals or the online video courses will comply with required engineering or local authority compliance. Plans and specifications provided are to Australian Standards, which must be complied with.

 

  1. Refund Policy

Due to the digital nature of our products (E-Manuals and Video Courses), Domeshells Australia Pty Ltd does not provide refunds except in rare and extreme circumstances, at the sole discretion of The Company. Once access is granted to the digital materials, the purchase is considered final.

 

  1. Applicable Law

This Agreement must be read and construed according to the laws of the State of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of that State.

 

  1. Modifications to Terms

The Company reserves the right to modify these terms and conditions at any time. Any such modifications will be effective immediately upon being posted on the website. Your continued use of the website and its materials constitutes your acceptance of the modified terms.
